These terms govern your use of the Genesis Financial website, the AI CFO portal, and our services. By using the site or engaging our services, you agree to them. Individual client engagements are governed by a separate written agreement; if that agreement conflicts with these terms, the engagement agreement controls.
1. Who we are — and what we are not
Genesis Financial is a veteran-owned (SDVOSB-certified) commercial finance firm. We provide three services: commercial finance brokerage, fractional CFO consulting, and contract support (certifications, registrations, and proposal writing for government and corporate contracts).
- We are a broker, not a lender. Financing decisions — approval, terms, rates, and timing — are made by lenders, not by us. We cannot and do not guarantee approval or any particular terms.
- We are not a law firm, CPA firm, or registered investment adviser. Our services are business consulting and brokerage. Nothing on this site or in the portal is legal, tax, accounting, or investment advice. Where a licensed professional is needed, we'll say so and recommend you engage one.
- We do not guarantee contract awards. Certification and proposal support improve your positioning; award decisions belong to the contracting agency or company.
2. The AI CFO portal
The portal includes AI-assisted features that organize transactions, track cash, flag items worth a look, summarize activity, and draft reports and options for your review. These outputs are informational tools, reviewed by a person, and are not predictions, guarantees, or financial advice. You are responsible for decisions made using them. Portal access requires an active engagement and credentials you agree to keep secure; multi-factor authentication is required on every login.

3. Fees
No hidden fees. Every fee is disclosed in writing and agreed to before any engagement begins. Financing compensation typically comes through the transaction when a deal funds; CFO engagements are priced upfront in your engagement agreement; contract-support proposal writing is largely success-based. Specific amounts and structures are set out in your written engagement agreement.
4. Your responsibilities
- Provide accurate, complete, and current information. Financing placements, financial reporting, and government filings all depend on the accuracy of what you provide.
- Use the site and portal lawfully and only for your own business.
- Keep your login credentials confidential and tell us immediately about any suspected unauthorized access.
- Review your engagement agreement — it defines the scope, deliverables, and fees for your specific services.
5. Third-party services
The portal and site connect to third-party services, including Plaid (bank connectivity), Intuit QuickBooks (accounting sync), and Calendly (scheduling). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services, though we choose partners with strong security practices.
6. Communications consent
By providing your phone number or email and requesting contact, you consent to receive calls, texts, and emails from us about your inquiry or engagement. 7. Intellectual property
The site, portal, and their content — design, text, software, and branding — belong to Genesis Financial or its licensors. Your business data remains yours; you grant us the limited rights needed to provide the services (for example, analyzing your connected financial data to produce your reports).
8. Disclaimers
The site and portal are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Information on this site is general in nature and may change; program availability and terms vary by lender and qualification.
9. Limitation of liability
To the fullest extent permitted by law, Genesis Financial will not be liable for indirect, incidental, consequential, or punitive damages, or for lost profits, arising from your use of the site, portal, or services. Our total liability for any claim will not exceed the fees you paid us for the service giving rise to the claim in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
10. Termination
You may stop using the site and portal at any time; engagement termination is governed by your engagement agreement. We may suspend or end access for misuse, non-payment, or security risk, with notice where practicable.
11. Governing law
These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute arising under these terms will be brought in the state or federal courts located in Texas, unless your engagement agreement provides otherwise.
12. Changes
We may update these terms from time to time. Material changes will be reflected in the date at the top of this page, and active clients will be notified where appropriate. Continued use after changes means you accept the updated terms.
